Welcome to Piclicks! These Terms and Conditions ("Terms") govern your use of our website, www.piclicks.com ("Website"), and the purchase of our products and services.

By accessing or using our Website, you agree to comply with these Terms. If you do not agree to any part of these Terms, please refrain from using the Website.

Products and Services

1. Piclicks Photo Tiles

   1. Piclicks offers modular wall art made from photo tiles, each measuring 144mm x 126mm. The modular system allows customers to build wall art in various shapes and sizes.

   2. Users can purchase additional sets of photo tiles to expand or replace existing designs.

2. Image Uploads and Online Editing App

   1. Our online editing app allows users to upload personal photos or select images from our on-site gallery to create customized wall art. Users can preview their photo tiles arranged in a grid format before placing an order.
   2. Users may use the editor without creating an account; however, saving their work requires an active Piclicks account.

   3. There are no specific limitations on file sizes or formats as long as our systems can process the uploads. Please note that production personnel will have access to the uploaded content during manufacturing.

      Content Responsibility:

      • Users are solely responsible for ensuring that their uploaded content does not violate any copyright, privacy, or other applicable laws. Piclicks reserves the right to refuse production of inappropriate or illegal content.

3. Gift Cards

   1. Piclicks offers gift cards that can be used to purchase any product on the Website, unless explicitly stated otherwise.
   2. Gift cards include an expiration date that is specified at the time of purchase. Please ensure to redeem the card before the expiration date.

4. Shipping Information

   1. Piclicks ships worldwide to most countries. Shipping availability will be confirmed at the time of checkout.
   2. Customers are responsible for any customs duties, taxes, or fees imposed by the destination country’s authorities. Piclicks will provide all necessary documentation and estimations to assist in customs clearance.
   3. Delivery times vary based on location and shipping method. While we strive to meet estimated delivery times, delays caused by customs or other unforeseen circumstances are beyond our control.

Orders and Payments

1. Order Confirmation

   1. After placing an order, customers will receive a purchase confirmation email. This email guarantees acceptance of the order and includes the details of the purchased items.
   2. Once an order is confirmed, it is processed promptly to ensure timely production and shipping.

2. Payment Options

   1. Piclicks accepts the following payment methods:

      • Credit Cards (Visa, MasterCard, American Express, etc.)
      • PayPal

   2. All payments must be made in full at the time of purchase.

3. Cancellation Policy

   1. Custom Photo Collages:

      • Orders for custom photo collages may be canceled if the order is still in processing and has not yet entered the printing phase.
      • Once production has begun on a custom photo collage, the order cannot be canceled or refunded, as the product is personalized and cannot be resold.

   2. Gallery Pre-Fabricated Items:

      • If a pre-fabricated gallery item has not yet shipped, the order may be canceled.
      • If the item has already shipped, the customer may return it for a refund, subject to the following conditions:
        • The customer is responsible for covering shipping costs to and from the delivery address.
        • The refund will be issued only after Piclicks receives and inspects the returned item to ensure it is in its original condition and packaging.

   3. Gift Cards:

      • Refunds for unused gift cards are allowed, provided the card is still valid and has not expired.

4. Refund and Return Policy

   1. Piclicks is committed to customer satisfaction and will work to resolve any issues related to orders.

   2. Refunds and returns are available under the following conditions:

      • For damaged, defective, or incorrect items, customers must notify Piclicks within 14 days of receiving the order.

      • For pre-fabricated gallery items, returns must be in their original packaging and condition.
      • Custom photo collages are not eligible for refunds once printing has begun.

   3. Refunds will be processed within 14 business days after the returned product is received and inspected. Refunds will be issued to the original payment method.

User Accounts and Website Use

1. Account Creation and Guest Checkout

   1. Users can check out as guests without creating an account. However, guest checkout users will not have access to certain features, including:

      • Saving photo collages for future editing.
      • Sharing editing work with other members.
      • Producing copies of previous works.
      • Accessing exclusive member benefits and promotions.

   2. To enjoy these features, users are encouraged to create an account on Piclicks.

2. Account Information

   1. Users must provide accurate and complete shipping and billing information when placing an order. Inaccurate information may result in delays or issues with the order.

   2. Users may request the deletion of their accounts by contacting Piclicks at avsh_noham@yahoo.com. Upon confirmation of the request, Piclicks will delete the account.

3. Use of Website Content

   1. Users may use visual content (e.g., images, photos, videos) from the website only if they provide proper attribution to Piclicks, including:

      • Including the caption “Image by Piclicks” beside or attached to the photo.
      • Adding Piclicks as the source in the image’s alt text.

   2. Users may use text from the website provided they:

      • Use entire sentences without modification.
      • Credit Piclicks as the source of the text.

4. Prohibited Activities

   Users are prohibited from engaging in activities that may harm the website, its users, or Piclicks as a business. The following actions are strictly prohibited:

   • Uploading Illegal or Inappropriate Content: Users must not upload content that is offensive, harmful, illegal, or violates Piclicks’ standards.
   • Copyright Infringement: Users must not upload copyrighted images or other materials without permission from the rightful owner.
   • Cyberattacks: Attempting to hack, disrupt, or otherwise compromise the website, its systems, or user data.
   • Spamming and Abuse: Sending unsolicited messages, spamming users, or engaging in disruptive or abusive behavior.
   • Intellectual Property Theft: Attempting to replicate, steal, or misuse Piclicks’ designs, code, or proprietary information.
   • Providing False Information: Misrepresenting oneself or submitting false information during account creation or transactions.

5. Enforcement and Remedies

   1. Piclicks reserves the right to suspend or terminate user accounts, cancel orders, or take legal action against users who violate these terms.
   2. In cases of severe violations, Piclicks may report activities to law enforcement or other relevant authorities.

Limitation of Liability and Disclaimers

1. Product Disclaimer

   1. While Piclicks strives to ensure that printed colors closely match the preview shown on the screen, slight variations may occur due to differences in screen settings, printing processes, and material properties. These variations are not considered defects and are part of the production process.

2. Shipping and Delivery

   1. Piclicks commits to processing and preparing orders for shipping within 5 working days from the order date. Once shipped, orders are expected to arrive at their destination within 7 working days.

   2. In some cases, delays may occur due to logistical challenges. If such delays happen, Piclicks will notify the customer and request up to 3 additional working days for delivery.

   3. Piclicks is not responsible for customs duties, local taxes, or other fees imposed by the destination country. Customers are responsible for handling these charges with their local authorities.

3. Force Majeure

   1. In the event of unforeseen international events that disrupt shipping routes, such as natural disasters, pandemics, or political unrest, Piclicks will notify customers of the situation. Piclicks reserves the right to delay delivery until the circumstances allow safe and reliable shipping.

4. Limitation of Liability

   1. To the fullest extent permitted by law, Piclicks shall not be liable for any indirect, incidental, special, or consequential damages arising from:

      • Delays in delivery caused by shipping providers or customs clearance.
      • Minor variations in printed product colors or imperfections inherent in the printing process.
      • Customer-provided content that violates third-party rights or results in legal claims.

   2. Piclicks’ total liability for any claim related to a purchase is limited to the amount paid for the order.
